Terms and Conditions 

Effective Date: June 5, 2025

Welcome to MTG education group (the “Firm,” “we,” “us,” or “our”). We provide premier college admissions consulting services to students and their families (“Client,” “you,” or “your”).

These Terms and Conditions (“Agreement”) govern your access to and use of our services, website ([Your Website]), and proprietary materials. By engaging our services, you acknowledge that you have read, understood, and agree to be bound by this legally binding Agreement.

1. Scope of Services The Firm offers advising and consulting services designed to guide the Client through the college application process. Our services may include, but are not limited to:

  • Holistic applicant profile assessment and development strategy.

  • Personalized college list curation.

  • Essay and personal statement ideation, structuring, and refinement.

  • Application review and strategic positioning.

  • Interview preparation and coaching.

  • Waitlist and deferral strategy advising.

Our role is strictly advisory. The Client retains ultimate authority and responsibility for all decisions and actions related to their college applications.

2. No Guarantee of Admission MTG education group is committed to providing the highest caliber of strategic advice to enhance the Client's admissions prospects. However, we make no representation, warranty, or guarantee of admission to any particular college or university. Admissions decisions are made solely by the respective institutions and are based on a multitude of factors beyond our control. Our fees are for the expert advice and time rendered and are not contingent upon admissions outcomes.

3. Client Responsibilities To ensure a successful partnership, the Client agrees to:

  • Provide Accurate Information: Furnish complete, accurate, and truthful information regarding academic records, extracurricular activities, personal history, and all other application components.

  • Academic Integrity: Uphold the highest standards of academic integrity. All written materials submitted to colleges, including essays and short answers, must be the Client’s own original work. Our role is to guide and edit, not to write, create, or ghostwrite content on behalf of the Client. The Firm reserves the right to terminate this Agreement immediately and without refund if we, in our sole discretion, suspect any form of plagiarism or academic dishonesty.

  • Timeliness: Adhere to all internal and external deadlines provided by the Firm and by the colleges. The Firm is not responsible for missed deadlines due to the Client's failure to provide information or complete tasks in a timely manner.

  • Active Participation: Engage actively in the process, including completing assigned tasks, attending scheduled meetings, and communicating openly with their consultant.

4. Fees, Payment, and Refund Policy

  • Fee Structure: Our fees are outlined in a separate Service Agreement, which is incorporated by reference into this Agreement. Fees may be structured as a comprehensive package or on an hourly basis.

  • Payment: All payments are due upon receipt of invoice, unless otherwise specified in the Service Agreement. We accept payment via [List Payment Methods, e.g., credit card, bank transfer].

  • Late Payments: A late fee of 1.5% per month may be applied to any outstanding balance not paid within 14 days of the due date.

  • Extended Absence / Service Hold Policy: For any student who must suspend services for a continuous period exceeding three (3) weeks, a Short-Term Enrollment  Surcharge will be assessed to reserve their place with their tutors. This policy provides flexibility for students and avoids the previous model of charging for an entire term of unused services. If the Client opts not to pay the surcharge, the Firm cannot guarantee the immediate availability of the consultant upon the Client's return.

  • Refund Policy: All fees paid to the Firm are non-refundable. Our fees compensate for the time, expertise, and proprietary resources dedicated to the Client upon engagement. In the event of early termination of this Agreement by the Client, no refunds for services rendered or for unused portions of a package will be issued.

5. Confidentiality The Firm agrees to maintain the strict confidentiality of all Client information, including academic records, financial data, and personal details ("Confidential Information"). We will not disclose such information to any third party without the Client's express written consent, except as required by law.

Likewise, the Client agrees to keep confidential all proprietary information, methodologies, worksheets, guides, and strategic advice provided by the Firm. These materials are the exclusive intellectual property of MTG education groupand are for the Client's personal use only.

6. Intellectual Property All materials, methodologies, software, and proprietary content provided to the Client are the exclusive intellectual property of MTG education group. The Client is granted a limited, non-exclusive, non-transferable license to use these materials solely for the purpose of their own college application process. Unauthorized reproduction, distribution, or commercial use of our materials is strictly prohibited.

The Client retains full ownership of their personal essays, application data, and other original content they create during the consulting process.

7. Term and Termination

  • Term: This Agreement begins upon execution of the Service Agreement and receipt of the initial payment. It terminates upon the Client's submission of all applications covered by the scope of services or on the date specified in the Service Agreement.

  • Termination for Cause: Either party may terminate this Agreement for a material breach by the other party, provided that written notice of the breach is given and the breaching party fails to cure the breach within 14 days.

  • Effect of Termination: Upon termination, the Client is responsible for paying for all services rendered up to the date of termination. Sections 2, 4, 5, 6, 8, and 9 of this Agreement shall survive termination.

8. Limitation of Liability and Disclaimer of Warranties TO THE FULLEST EXTENT PERMITTED BY LAW, MTG education group, ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY DECISIONS MADE BY COLLEGES OR OTHER THIRD PARTIES; (C) ANY ERRORS OR OMISSIONS IN YOUR APPLICATION MATERIALS.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF MTG education group EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO THE FIRM UNDER THIS AGREEMENT. THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED.

9. Indemnification You agree to defend, indemnify, and hold harmless MTG education group and its affiliates, officers, directors, and employees from and against any claims, damages, costs, liabilities, and expenses (including, but not limited to, reasonable attorneys' fees) arising out of or related to your use of our services, including but not limited to your breach of any representation, warranty, or other provision of this Agreement, or your provision of false, misleading, or plagiarized information.

10. Governing Law and Dispute Resolution This Agreement shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law principles.

Any dispute arising from this Agreement shall be resolved through final and binding arbitration in [City], [State], administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

11. General Provisions

  • Entire Agreement: This Agreement, together with the Service Agreement, constitutes the entire agreement between the parties and supersedes all prior communications.

  • Severability: If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

  • Waiver: The failure of the Firm to enforce any right or provision of this Agreement will not be deemed a waiver of such right or provision.

  • Amendments: We reserve the right to modify these terms at any time. We will notify you of any changes by posting the new Terms and Conditions on our website. Your continued use of our services after such a change constitutes your acceptance of the new terms.
